The machinations the govt has used—and continues to use—to manufacture specious pretexts to justify refusal to obey court orders are breathtaking in the disdain they exhibit for the third branch.
The Roberts Court brought all this on itself—and on us—with its July presidential immunity decision that licensed Trump to try to get away with exactly the kind of things he is doing now.
The bitter irony is that Roberts justified his “restraint” under a dubious theory that an unelected Court must avoid becoming caught up in political controversy with the elected executive, lest the Court lose the appearance of legitimacy.
In practice, Roberts’ theory led him to avoid issuing any decision that would meaningfully restrain the president on any significant controversial issue.
But when the Court has both a Constitutional basis and a moral duty to prevent a lawless president’s attack on the right of due process—which is the fundamental right upon which all other individual rights depend—the Court’s failure to restrain the president is a moral failure that makes the Court appear to be unwilling or unable to fulfill its proper Constitutional role. In our Republic, that is the very definition of “illegitimate.”
Do remember that the immunity decision is limited to "core powers." So the question is, will the court decide that denying due process is a "core power" of the president because it involves "foreign policy."
The illegality is so flagrant. Para 2 of the order binds "successors, assigns, and persons acting in concert or participation with [Defendants]," which surely catches DoD in these circumstances.
This is my opinion only. Trump and his personal soldiers are the ConMen Supremes! They will find any way possible to avoid doing what the Courts order. We need a new approach to squash his actions. He does not care at all about this country or its citizens. He is using his Presidency to make him and his family wealthier; to try and kick his enemies in the teeth with whatever he can imagine; to show the world that he is the greatest of all Strongmen. He has absolutely no moral compass , no sense of the common good, no conscience to guide any of his actions. My fear is that as much as we resist, we cannot change the destructive course that he has put our nation on. His damage to our democracy in 100 days is almost incomprehensible even to those of us who are following the daily actions of his administration and the actions taken by the opposition. I am deeply concerned that even with a major shift in parties in the 2026 elections we will not be able to save our crumbling democracy. Unless we are able to MOVE the Republicans to take action against this unconstitutional Presidency, now, i fear our collective efforts while brave, will not be enough to save us.
Are there any conversations happening about Dems and Republicans meeting privately to come to some common ground? Regardless of the rage and disgust we may have for their silence/complicity, we need them to see Trump for who he truly is. And we need greater coalitions of people from all races, all geographical locations, all faiths, all social locations or classes, to march together, even amidst some political differences.
His entire regime is built on White Supremacy, and White Christian nationalism. In my opinion, this is our only hope of slowing down the damage until we have a sane and responsible government once again.

I grew up in one of the E European brutal dictatorships and watching all of this unfold is incredibly frustrating. I live in a big blue bubble in the Bay Area and I’m watching folks just going about their lives, a bit worried, but still in denial that this downhill can be reversed. I try to emphasize that we could be looking at decades of autocratic ruling at this point and 2026 will be probably rigged elections, or pointless. I know that even most of my friends think I’m overreacting. I agree with you: it will require a general uprising to stop all of this and it’s not happening, or it’s not happening fast enough. 💔

May not be sufficient, but it would be a good start.

They can’t over rule the immunity decision until they have a case that gives them the opportunity to do so. One would hope that they would recognize how wrong their immunity decision was given the results of that decision but we can’t be sure that they will.
A future case where the government charges the President with a crime or a revival of the January 6’th case or the documents case once Trump leaves office. The Supreme Court can only issue decisions through cases before it. It can’t just vote on things like Congress does.
So, with what is going on with this El Salvador case being fought for by the ACLU..... will that be tried in the lower court? If so, and is won, can that case be used and taken to the Supreme Court to try the President? Or, because you mention that the government needs to bring it forward, we would need the REPUBLICAN Congress to strap on some balls, and step forward?
Not sure. I think the ACLU case related to El Salvador is a civil immigration case arguing that the deported individuals had their due process rights violated and the cure would be to bring all those people renditioned to El Salvador back and give them a hearing. The difficulty in the case is whether the courts have the power to force the executive branch to do that. This starts in the lower federal courts and issues come up in the litigation that can be appealed to the circuit courts and eventually the Supreme Court. The justice department has a policy that it won’t criminally charge the president while he is in office. Pam Bondi wouldn’t do it anyway. Could a State bring kidnapping charges against the feds and charge a conspiracy that includes the President? I would love that! Would the Federal Courts allow that to go forward? I don’t know. Congress would have to impeach the President or pass a law forbidding the action which the Republicans won’t do. Honestly, I don’t see how it is legal to send anyone to a prison in El Salvador with no criminal charges and no trial. Trump, Miller, Noem, the ice agents, all of them belong in jail.

Shifting the actions from one department to another isn't new. That's how the Reagan administration carried out Iran-Contra, in which it armed the Nicaraguan Contra rebels using funds obtained from selling embargoed arms to Iran despite a specific Congressional ban on funding the Contras. The administration claimed that Congress had only outlawed the CIA and DoD from providing funding, and, anyways, the money came from Iran, not the US. Courts generally did not agree with this hide-the-ball interpretation, but the actions could not be undone. The relevant individuals were all pardoned by Bush I--who himself was implicated--ending the investigations into Iran-Contra. Just in case you thought that Trump invented all these tactics.
